Differences Lead to STL Judge Resignation amid Alleged Indictment of 5th Hizbullah Member

The resignation of the presiding judge of the international tribunal's trial chamber came over his objection to several measures that contradict the court's rules of procedure, As Safir daily reported on Wednesday.

The newspaper also claimed that the Special Tribunal for Lebanon, which is prosecuting ex-Premier Rafik Hariri's suspected assassins, had issued an indictment against a fifth Hizbullah member but the case was closed.

The STL announced on Tuesday that Judge Robert Roth, presiding judge of the trial chamber, has resigned.

“It is unfortunate that he will not be presiding over the trial of the accused, currently scheduled to start in January 2014,” the statement said.

But As Safir said Roth resigned after he objected to certain measures that are inconsistent with the tribunal's rules of procedure and evidence in addition to some interferences in the appeal made by the defense teams of the accused.

The daily said that the court and Hizbullah liaison officer Wafiq Safa agreed to “close the file” of an indictment against a fifth Hizbullah member after two powerful car bombs rocked the party's stronghold in Beirut's southern suburbs.

The court has accused four Hizbullah members, Salim Ayyash, Mustafa Badreddine, Hussein Oneissi, and Assad Sabra of being involved in the February 2005 suicide car bomb attack in Beirut that killed Hariri and 22 others, including the suicide bomber.

They will go on trial in absentia over the failure of the Lebanese authorities to arrest them.

you mean our leaders should be killed and no tribunal should look into the murderers. What about the guy that was trying to plant a bomb at Harb's office. He was arrested, he is a HA and he was freed by force by HA and no one can arrest him or judge him.

Thumb Maxx 11 September 2013, 13:24

Oh? But I suppose the Iranian Occupation Forces - Hizb - and their weapons are a legal establishment, is not imposed upon the Lebanese by Syria and Iran, and does not piss on the Lebanese Constitution, right?
Thank you very much, we know the truth.

Why do you people bother. What do you expect the guilty party that has been caught red handed to say. Their persistent attack against the Tribunal is quite normal.

lol do you have your own personal definition of "red handed"? please share it with us, because by all generally accepted standards, circumstantial evidence, all relying on telecom data (after spies gave israel full access to our telecom servers for several years at least) does not qualify as a red handed.

you forget the guy who was caught trying to bomb Harb's building.
EVERYONE knows who was behind it.
The guy who caught him used to be a police officer.
The investigation was purposefully mishandled, and the guy who caught him didn't really want to put his family at risk. He didn't want to be another unsolved assassination.

Hezbollah is a terrorist organization. It should be dismantled and and its decision makers and armed members tried in Lebanon and in the Hague.

Thumb eagle_eye 11 September 2013, 16:02

Why would Hezbollah free Lebanon of Israeli occupation then turn around and assassinate a Lebanese who was doing good to rebuild the country? Here Hezbollah may have been incorrectly accused and quite possibly because of their association with Bashar al Assad who could have been involved in the loss of this good man. Otherwise there may be a conspiracy to set up Hezbollah as the 'bad guy' by a more secret agenda to destabilize the arab region. This secret agenda is using the arabs' greatest weakness to divide them, that being the different religions.

okay benzona, only if the terrorist state of israel is dismantled and its decision makers and armed members are brought to the hague first :)
